Welcome to Fijo. By accessing or using the Fijo mobile application or website (collectively, the "Service"), you agree to these Terms of Service ("Terms"), our Privacy Policy, and any additional rules posted within the Service. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use Fijo. By using the Service, you represent that you have legal capacity to accept these Terms and, if you act on behalf of a business or organization, that you are authorized to bind it.
2. Accounts
You are responsible for maintaining the confidentiality of your login credentials, keeping your account information current, and all activity under your account. You may not transfer, sell, or share your account in a way that allows unauthorized use of the Service. Notify us immediately at support@fijo.pa if you suspect unauthorized access.
3. User Content
You retain ownership of the content you post (listings, photos, reviews). By posting, you grant Fijo a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, reproduce, display, technically adapt, distribute, and communicate that content within the Service, and to promote Fijo or your listings in channels related to the Service.
You agree to post only content that:
- Is accurate and not misleading.
- You have the right to share.
- Does not infringe on the rights of others.
- Clearly describes prices, conditions, availability, and relevant limitations of the service offered.
- Is not illegal, harmful, threatening, harassing, defamatory, obscene, or otherwise objectionable.
4. Prohibited Activities
You may not:
- List illegal, fraudulent, or dangerous services.
- Impersonate any person or entity.
- Spam, harass, or abuse other users.
- Publish false information, misleading prices, nonexistent credentials, or manipulated reviews.
- Request or share unnecessary, sensitive, or unrelated personal information for hiring or providing a service.
- Attempt to circumvent our safety mechanisms, including reports and verification.
- Scrape, reverse-engineer, or automate access to the Service without our written permission.
- Upload malware or interfere with the Service.
5. Marketplace Role
Fijo is a platform that connects service providers with customers. Transactions, quality of work, payment, and delivery are between users. Fijo is not a party to any transaction and does not guarantee the quality, safety, or legality of services offered.
Fijo does not employ, represent, or supervise providers who post services, and does not act as an agent, broker, insurer, guarantor, or payment processor between users. Each user is responsible for verifying identities, permits, licenses, experience, prices, conditions, dates, materials, warranties, and any applicable legal requirements before hiring or providing a service.
6. Payments and User Agreements
Fijo facilitates direct contact. Unless we expressly state otherwise within the Service, payments, deposits, refunds, cancellations, taxes, receipts, warranties, and claims are agreed and managed directly between the customer and provider. Fijo does not charge commission for jobs obtained and is not responsible for payments made outside the Service or disputes between users.
7. Reviews, Reports, and Moderation
Reviews must reflect genuine experiences. We may remove reviews that violate these Terms, are false, abusive, deceptively incentivized, or unrelated to a real experience. Users can report inappropriate content; Fijo may review reports, limit visibility, request additional information, remove content, or suspend accounts at its reasonable discretion.
8. Verification
Profile verification is optional. A verification badge indicates that Fijo has reviewed submitted identification, but it does not guarantee the provider's competence, honesty, background, permits, availability, solvency, or legal standing. We may approve, reject, revoke, or request verification again if we detect inconsistencies or risks.
9. Premium Features and Promotions
Fijo may offer free or paid features, such as featured listings, category sponsorships, or other visibility tools. The availability, duration, price, and conditions of these features may change. Purchasing or activating a visibility feature does not guarantee contacts, sales, hiring, or specific results.
10. Termination
We may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any conduct that we determine harmful to other users, third parties, Fijo, or the Service. We may also remove listings, limit features, or block contact methods when needed to protect the platform. You may delete your account at any time from within the app, subject to any pending obligations or information we must retain for legal, security, or fraud-prevention reasons.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. Fijo disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or free of security failures, or that information posted by users will be complete, accurate, or current. Your use of the Service and any hiring between users is at your own judgment and risk.
12. Limitation of Liability
To the maximum extent permitted by law, Fijo and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use or inability to use the Service, user content, communications or agreements between users, or services provided by third parties.
13. Indemnification
You agree to indemnify and hold harmless Fijo from any claims, damages, or expenses arising from your content, your use of the Service, or your violation of these Terms, applicable law, third-party rights, or any agreement, service, payment, or dispute with another user.
14. Governing Law
These Terms are governed by the laws of the Republic of Panama, without regard to conflict-of-law principles.
15. Changes
We may update these Terms at any time. When we do, we will update the "Last updated" date. Continued use of the Service after the changes take effect constitutes acceptance. Material changes will be announced in-app, by email, or through other reasonable means.
